Pre-Nuptial Agreements / Matrimonial Agreements

Louisiana is a community property state. Alternatively, couples entering into marriage can choose to enter into a Matrimonial Agreement altering or rejecting community property.

The most common form of a “pre-nup” in Louisiana is one that rejects community property and keeps a separation of property arrangement, meaning each member of the couple keeps what they earn or acquire during the marriage.

Pre-Nups Aren’t Just for the Wealthy

Because of Louisiana’s community property laws, it may be advisable to consider a Matrimonial Agreement especially in cases of re-marriage. For example, child support for children of prior relationships is considered a debt of the community and a spouse could be liable to pay those debts.
